Illegal crackdown and constitutional breakdown in Balochistan
| By Hafeez Hasanabadi – Translated by Zabaad Baloch Pakistan’s Chief justice has been hearing cases of abducted Baloch from past six months in Balochistan. He has been passing remark after remark and giving date after date but with no affect. He admits that no one listens to his orders; neither the Police are answerable here nor the FC, ISI and other security agencies are ready to accept their crimes. He went on to say, “We have asked for people to be produced before the court but instead they were killed and dumped. The provincial government has become completely ineffective, from the chief minister to other provincial minsters and bureaucrats have nothing to do with the affairs of the province; everyone is trying to hide from the factual situation. Hence there is a constitutional crisis in Balochistan.” These remarks of the Chief Justice are true because the Voice for Baloch Missing Persons in Balochistan and the International Voice for Baloch missing Persons on International level has been always long saying that the state security agencies are the real culprits of violating the human rights of the Baloch people. Active members of International Voice for Baloch Missing Person with guidance of Baloch leader Hyrbyair Marri have been raising these issues with a clear vision in America, Europe, Canada and elsewhere. Their hard work and efforts have exposed the Pakistani barbarism and painted a clear of Baloch freedom movement. The question that arises now is that if the Chief justice is saying the same thing which we (Baloch) have been saying then why there is still disagreement? The answer is quite easy that Baloch have no complaints against any individual officials or institutes but their problem is the state itself that is why none of the departments of the state can be sympathetic towards the Baloch people. In other words the Baloch interests are contradictory to the interests of the state. All the institutions of the state including the Supreme Court are trying to force or convince the Baloch nation to remain within Pakistan so that their natural resources and Sea Coast can be used as oxygen to keep Pakistani state alive. Whereas the Baloch want to become the master of their own destiny so that their history, cultural, language and national identity is not endangered – it is impossible to save the aforementioned values within Pakistan. Since Pakistan came into being it has been repeatedly saying that abandon your identity as Baloch, Sindhi, Pashtun and Punjabi – all nations should call themselves Pakistanis. Those who do not understand the poisonous mindset of Pakistan and become prey of this beautiful slogan, they are actually becoming part of a policy to lose everything and leave their next generations stranded but sensible people would consider it their duty to oppose this disgusting conspiracy because they know the fact that Punjab wants shift its 52% population on their land in an effort to exploit their resources to run Punjab’s crumbling state. Balochistan which is 44% of Pakistan’s land with a population of only 5% of that country (Pakistan) under this formula it is not difficult to understand this anti Baloch slogan that they [Pakistanis] do not need the Baloch people they need the Baloch land. Now let’s try to find out that how the Chief Justice is trying to resolve the Balochistan issue in the light of above formula and is it possible? The answer is in negative! Because he has not even paid attention to the real problem yet then how can he resolve this issue. During all the court hearing none of the judges including the Chief Justice has said that the Baloch activists have been arrested and extra-judicially killed for demanding their freedom and that freedom is their basis right. As the Pakistani military leadership and politicians try to hide facts by saying that there is no freedom movement in Balochistan. The top judges of Pakistan judiciary have also adopted the same policy but they are forgetting the fact that ignoring the root cause will make it more complicated. The fact of the matter is all those people that have been either disappeared to killed under-custody are/were either leaders or members of pro-freedom Baloch political parties. The other reason of abducting them by FC and Pakistan security agencies is that these people are/were well-wishers of Baloch freedom movement. Until the Pakistan army and its judiciary declare that demanding freedom in a democratic manner is criminal offense, they cannot resolve the issue of enforced-disappearance let alone solving the issue of Balochistan. It is pertinent to remember that the Baloch activists that have been disappeared and killed, they were not criminals or thieves but they were/are ideological leaders and workers. If the Chief Justice cannot imprison their ideology and declares the limits of freedom, the abducted Baloch upon their release will against continue the very same struggle for which they were arrested. Hence Pakistani forces have not imprisoned Baloch activists but tried to imprison their thought of freedom and they have not killed hundreds of Baloch students, intellectuals, lawyers and political leader but they tried to kill the ideology of freedom which demands an independent and sovereign Baloch state. Those Baloch who have been either disappeared or killed, they have hundreds of thousands of ideological followers and they are still at liberty – the state is abducting and killing them one by one. The Chief Justice must also understand the fact that Pakistan state has failed to buy the loyalty of these activists with the powers of it bombs, bullets and greed. Now to conceal its defeat the state has now adopted the barbaric policy of abduct, torture and kill and dump. To resolve the issue of enforced-disappearances in Balochistan the Chief Justice needs to study some historical incidents and find a solution in light of combining those historical chains. We hope that Chief Justice and majority of other sensible people are well aware of the fact that eliminating Baloch nation is not possible because with each passing day immense internal and foreign pressure will continue to increase on Pakistan, which is why the FC instead of accepting its crimes has asked to be given the police powers which proves that this institute of state (FC) is trying to legitimize its powers that it has been using unlawfully. This also clearly indicates that the FC is not ready to change its policies. In this case the question arises how will the court deal with them? If we see in legal point of view, there is very less that the court can do and on practical ground court cannot do anything at all but to become a silent spectator like other institutes of the state. As the parliament despite being a crime partner in Baloch genocide exempts itself from crimes, the Prime Minister, the speaker and the President verbally accept crimes against Baloch but who is committing these atrocities and how to stop these atrocities, no one has been able to give a satisfactory answer to this question. They state officials sometimes say that the FC has been deployed in Balochistan on the request of provincial government and then they say FC operates under GHQ. Similarly, the chief minister Balochistan say they [FC] work on his orders while on the other hand he says FC has established a parallel government in Balochistan and that his status is less than of a street hawker. Each one tries to throw the ball in others’ court but this cannot heal the wounds of Balochistan. The policy of abduct, kill and dump has not changed in fact kill and dump is intensifying and expanding with each passing day. Nobody is willing to tell and face the truth because telling the truth and practically acting upon it will cut their artificial wings which are provided to them by these criminal institutions. The Judiciary cannot do more than lip service in fact some of our friends believe that the judiciary is trying to pave a way for governor rule in Balochistan by passing commits like the situation is out of control which is a valid prediction but personally I reject this discussion for time being. In my next article “Has anything left” we will discuss and try to find out why the Chief Justice has remembered Balochistan after such a long time? However, I will conclude my this discussion briefly saying that Chief Justice’s remarks that there is a judicial break down because of the illegal crackdown – are a strong proof of this country [Pakistan’s] state terrorism which no ruler and general can deny and it is enough to drag Pakistan to the international court of justice.
